The new federal law, the Cannabis Act, comes into effect on Oct. 17, 2018. The new legal framework takes a public health approach to cannabis legalization and regulation. Each province and territory will have the ability to set its own rules for cannabis including:

  • Legal minimum age
  • Where you can buy it
  • Where you can use it
  • How much you can possess

Cannabis in New Brunswick

The Government of New Brunswick is prepared for the legalization of adult-use cannabis in Canada. New Brunswick has put in place legislation to address the issues related to cannabis within its jurisdiction.

Quick legal facts

The combined effect of the federal and provincial laws related to cannabis may be summarized as follows:

  • The minimum age to possess, purchase and consume cannabis is 19. Persons under the age of 19 can be fined or prosecuted if they’re caught with cannabis
  • Adults 19 and older will be able to legally buy up to 30 grams of cannabis from a Cannabis NB retail store
  • It will be against the law to:
    • Consume cannabis in a public place
    • Consume cannabis in or on a still or moving vehicle
    • Distribute cannabis to a minor
