Terms and conditions

  1. Contest Sponsor: The Contest is administered, operated and sponsored by the University of New Brunswick (the “Contest Sponsor”). This Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook or Twitter. This contest is not in any way sponsored or administered by Groundspeak, Inc. DBA Geocaching.

This Contest will be run in accordance with these Rules and applicable federal, provincial, and local laws, subject to amendment by the Contest Sponsor. Entrants must comply with these Rules, and, by entering the Contest, will be deemed to have received and understood the Rules.

  1. Contest Period: The Contest starts at 08:00 am AT on September 11, 2017, and continues until 11:59 pm PT on October 30th, 2017 (the “Contest Period”).
  2. Eligibility: The Contest is only open to legal residents of Canada, who are at least nineteen (19) years old at the time of entry. Employees of the Contest Sponsor and Groundspeak, Inc. DBA Geocaching (“Geocaching”), along with their respective parent and affiliate companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, provincial, municipal, and local laws, statutes, rules and regulations and is void where prohibited by law. Participation in the Contest constitutes entrant’s full and unconditional agreement to these Rules. The Contest Sponsor’s decisions are final and binding in all matters related to the Contest.
  3. How to Enter: To enter and participate in this Contest, entrants must have an account with Geocaching. If an entrant does not have an account, he/she can register on http://www.geocaching.com.
  4. To participate in the Contest, entrants will be required to either hide or find a UNB ForEM trackable geocoin, and to share a photo relating to this trackable on Instagram, Facebook, or Twitter. Entrants can do this by either (i) receiving a UNB ForEM trackable coin from their professor (while supplies last) or (ii) finding a geocache containing a UNB ForEM trackable coin.

(i) Entrants can receive a UNB ForEM trackable geocoin from a ForEM faculty member in appreciation of academic dedication or excellence.

OR

(ii) To find a UNB ForEM trackable, visit www.geocaching.com/innerexplorer and click on the “Find a Trackable” link. A map will be displayed with the locations of geocaches that contain Hurtigruten trackables. Visit any of the geocache locations to search for a Hurtigruten trackable. Please note that previous geocache visitors may have already retrieved the Hurtigruten trackable from the geocache.

To enter the Contest, entrants must post a photo on Instagram, Twitter, or Facebook of themselves connecting with their inner explorer and holding a UNB ForEM trackable coin, and must use the hashtags #DiscoverForEM and #contest. Entrants must share their photo publicly to be entered in the Contest. Photos shared on Instagram profiles that are private will not be eligible. After submitting your photo, please re-hide the trackable geocoin in a geocache so that other people can participate. Be sure to submit a log entry for the UNB ForEM trackable by visiting http://www.geocaching.com/track or through the free Geocaching mobile app.

Photo submissions uploaded after the Contest Period ends at 11:59 pm PST on October 30th will not be considered.

  1. Use of Photos: By submitting an entry photo using the method described above, the entrant grants a license to share his/her entry photo (or any part thereof) and/or use his/her name on the UNB or Geocaching website, or any other website related to the Contest, at any time. Entrants shall have no right of notice, review, or approval of any such use of the entry photo and/or entrant’s name, and acknowledges and agrees that the entry photo (or any part thereof) and/or his/her name may be used in whole or in part, alone or in combination with other works, and that the entry photo may be changed, altered, edited or modified as solely determined by the Contest Sponsor. Entrants retain all copyright to their images and are free to re-use them elsewhere outside of this Contest.

By entering, each entrant confirms his/her entry:

(i) Is the sole, exclusive, and original creation of the entrant and has not been copied in whole or in part from any other work;

(ii) Does not violate or infringe any copyright, trademark/trade name, logo, or intellectual property right of any person or entity;

(iii) Is truthful in all respects, and accurately depicts and describes the facts and geocaching experience of the entrant.

Submissions that promote or display the exploitation of people, cultures, animals or natural environments will not be considered.

WARNING: ANY ATTEMPT BY AN ENTRANT OR OF ANY OTHER PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR SOCIAL ACCOUNTS OF GEOCACHING OR THE CONTEST SPONSOR, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. IF ANY SUCH ATTEMPT IS MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEY’S FEES) FROM ANY SUCH ENTRANT, FOLLOWER OR OTHER PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING SEEKING CRIMINAL PROSECUTION.

  1. Judging: One (1) Grand Prize winner and five (5) secondary winners will be selected by the Contest Sponsor based on the following criteria: (a) originality of post, (b) quality of photo, (c) creativity of caption, and (d) promotion of the Contest Sponsor’s brand values and messaging. The Contest Sponsor will evaluate all potential winners to confirm they are not employed by UNB or Geocaching.
  2. Winner Notification: All winners will be notified via comment on their social media account and instructed as to how collect their prize.
  3. Prizes:
    (i) The grand prize winner will receive a $100 gift card to Mountain Equipment Coop. Prize does not include travel to a store location. The grand prize is non-transferable and cannot be altered or exchanged for cash, or other goods and services. If the winner does not contact UNB within 7 calendar days of being notified of winning, the prize will be forfeited and another winner will be selected.

    (ii) The second place winners will receive one (1) UNB sustainability portable bamboo utensil pack. If the winner cannot claim the prize in person, he/she may elect to have it mailed at his/her own expense.  
  4. Selection of Winner:  Any Winner’s failure to acknowledge receipt/acceptance of Prize within seven (7) calendar days after notification is sent by Sponsor, or the return of any Prize notification as undeliverable will result in disqualification of the Winner without further notice and an alternate Winner will be selected from among the remaining eligible Entrants. If a Winner cannot accept a prize as stated, the prize will be forfeited in its entirety and awarded to an alternate winner. No substitution, cash redemption or transfer of a prize shall be permitted but Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize is unavailable. Winners may be required, within seven (7) days following notification by Sponsor, to prove eligibility to the satisfaction of the Sponsor, including verification of age and residence.  At the discretion of Sponsor, Winners may also be required to sign an affidavit of eligibility release.  Noncompliance with any of these conditions will result in disqualification and selection of an alternate Winner.
  1. Prize Substitution:  The Contest Sponsor reserves the right, in its sole discretion, to substitute and/or modify any prize with (a) Prize(s) of equal or greater value for any reason.
  2. Conditions of Participation: By participating in the Contest, each entrant agrees to the following:

(1) Each entrant is responsible for complying with these Official Rules. No correspondence will be entered into except with the selected Winner who will be notified in accordance with these Rules.

(2) In the event of any inconsistency or discrepancy between the terms and conditions of these Rules and statements contained in any Contest-related materials, the terms and conditions of these Rules shall prevail, govern and control.

(3) Except where prohibited, the entrant agrees that:

(i) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prizes awarded shall be resolved individually, without resort to any form of class action;

(ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and

(iii) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and

(4) By participating, each entrant also agrees (a) to be bound by these Official Rules; and (b) that the decisions of the Contest Sponsor are final and binding with respect to all matters relating to the Contest. By accepting a prize, the Winner agrees that the Contest Sponsor and Geocaching may use the Winner’s name in any publicity or advertising relating to the Contest without further compensation or approval (except where prohibited by law).

  1. Right to Cancel or Suspend Contest: If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Contest Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Contest Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest. In such event, no prize of any kind will be awarded and the Contest Sponsor and Geocaching assume no responsibility for such failures and causes beyond the Contest Sponsor’s or Geocaching’s control. The Contest Sponsor reserves the right, in its sole discretion, to change the terms of this Contest or to cancel or suspend this Contest at any time for any reason whatsoever, without prior (or any) notice.
  2. Publicity: By accepting a prize, the Winner agrees that the Contest Sponsor and each of its respective designees may use his/her name, photograph, city of residence, biographical information, prize information and/or statements about this Contest for advertising and/or publicity purposes in any and all media (now or hereafter known) throughout the world, in perpetuity without compensation, notification, or permission, unless otherwise prohibited by law.
  3. Release and Liability: By entering this Contest, entrants forever release and hold harmless the Contest Sponsor, Geocaching and each of their respective parents, subsidiaries, related companies, franchisees, and each of their respective shareholders, members, officers, directors, employees and agents from and against from any and all damages, injuries, death, loss, or liability to person or property, due in whole or in part, directly or indirectly, by reason of entering the Contest, the acceptance, possession, use or misuse of any prize, or while preparing for and/or participating in any Contest and/or prize-related activity. The Contest Sponsor and Geocaching assume no responsibility for (1) lost, stolen, delayed, damaged, or misdirected entries or for typographical or other production errors; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service or trackable item; (4) unauthorized human intervention in any part of the entry process or the Contest; (5) electronic or human error which may occur in the administration of the Contest or the processing of entries; 6) any injury or damage to persons or property, including but not limited to entrant’s computer or smartphone, which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the Contest. If, for any reason, an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant’s sole remedy is another entry.

Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of the criminal and civil laws of the United States. Should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.
