"A Judiciary Cleaved: Superior Courts, Statutory Courts, and the Illogic of Difference"
Save for the Supreme Court, the jurisdiction and powers of statutory courts are interpreted differently—and often more restrictively—than those of the superior courts. This difference creates real practical problems. Eliminate the difference, and Canada’s judicial branch would be strengthened, with benefits for access to justice and our democratic governance.
Justice Stratas has served on the Federal Court of Appeal since 2009 and the Court Martial Appeal Court of Canada since 2012. Educated at Queen’s University and Oxford University, he has published over 110 conference papers and articles and was recently named one of the top 25 most influential players in Canadian Law by Canadian Lawyer Magazine.
