A REGULATION WITH RESPECT TO
THE ELECTION OF STUDENT MEMBERS TO THE BOARD OF GOVERNORS
1. Autho rity
Pursuant to S. 74 of the UNB Act, the Board of Governors makes the following Regulations in exercise of
the pow ers conferred to provide for the electio n of stude nt mem bers to the B oard un der S. 23(1)(n ).
2. Interpretation
(a) "Board" m eans the Boa rd of Governo rs;
(b) "eligible student" m eans a full- time graduate or undergraduate student who has completed
registration, or a part-time student registere d in a certificate or degree program, on either campu s;
(c) "in good academic standing" means not on academic probation;
(d) "mem ber" mean s a student me mber of the B oard elected und er these Regulations;
(e) "posted" means posted in conspicuous places on bulletin boards n ear entranc es to ma in academ ic
buildings on the ap propriate camp us;
(f) "published" m eans printed in new spapers or bulletins on the appropriate cam pus;
(g) "Secretary" means the Secretary of the Bo ard on the Fredericton Cam pus and the Cam pus Secre tary
on the Saint Joh n Cam pus;
(h) "Cou ncil" mean s the Stude nt Repre sentative C ouncil or S tudent U nion C ouncil on the appro priate
campu s;
(i) "year" means the "regular academic year" as defin ed in the UNB Act, viz: "the period of time from
the date set for the gene ral com men ceme nt of lectures in the m onth of S eptem ber in an ac adem ic
year to the d ate set for the conc lusio n of E ncae nia ex ercise s in tha t academic yea r, inclu sive."
3. Elections
(a) An election for the return of a mem ber shall be held in accordance with these Regulations whenever
the term of a member in office is to expire, has expired or ends by reason of resignation or any other
cause.
(b) Regular elections sh all be held d uring the seco nd half of the winter term on a date determined by
the Secreta ry in consu ltation with th e Chief R eturning O fficer of the C ouncil.

(c) Special elections m ay be held w here a vacancy o ccurs:
(i) when the required number of members has not been elected during the regular election;
(ii) because of death or resignation;
(iii) when the Secretary determines that a member is no longer eligible under these regulations.
(d) When an election is direc ted und er these Re gulations, it m ay be held in conjun ction with a Coun cil
election.
(e) Notice of an election pursuant to these Regulations shall be published and/or poste d, and sha ll
contain the follow ing particulars:
(i) the number of candidates to be elected;
(ii) the terms of office;
(iii) the eligibility qualifications to stand for nomination and to vote;
(iv) the place, date and h our for the closing of no minations;
(v) the date of the vote.
(f) A published or posted notice containing the particulars in (e) above, shall be deemed to be notice
to all eligible candidates and vo ters.
(g) Elections held under these Regulations shall be subject to th e cam paign and polling rules approved
by the Council; should the Council rules conflict with these Regulations, then these Regulations
take precedence.
4. Eligibility
(a) The Secretary shall be responsible for determining whether or not a nominee is eligible.
(b) A candida te must b e an eligible grad uate or un dergradua te student in good aca dem ic standing in
the University, as defined in 2 (b) and (c) above.
(c) A candidate may be enrolled in any year o f a program , but is not eligible if sc heduled to graduate
in the Spring or Fall of the election year.

(d) Appe als against a ruling of ineligibility may be made by the nominee, o r by a member ruled
ineligible under 6 (d), accompanied by a colleague or counsel, to the Board Nominating and Review
Comm ittee, whose findings, which shall be binding and final, shall be reported to the Secretary.
(e) A candidate ineligible under 4(c) may stand for ele ction if clear ev idence is provided of continuing
enrolment at UNB beyond the date of graduation (N.B. -- intention s are insufficie nt).
(f) A member expelled fro m the B oard is not e ligible for re-election for a period of twelve months after
the date of expulsion.
(g) Any eligible student at the time of the election may vote.
5. Nominations
(a) Nominations shall be on prescribed forms (A ppend ix A or B), available from the Secretary or the
Coun cil.
(b) For each nomination, there shall be a nominator, a seconder and at least twenty (20) supporting
signatures in Fredericton, and twelve (12) in Saint John, all of who m m ust be eligible students on
the appropriate cam pus.
(c) A student must give written consent to being placed in nomination.
(d) Nom inations m ay be filed e ither at the offic e of the Se cretary or the C ouncil.
(e) A candidate may withdraw at any time before the close of nominations, and at any time thereafter
up to two business d ays following the close o f nomina tions, by filing a notice of withdrawal at the
office of th e Secretary o r the Cou ncil.
(f) The Secretary shall set a closing date for the receipt of nominations which shall be at least two
weeks prior to the date of the election.
(g) In the event tha t when n omin ations close the num ber of no minee s equals the num ber of seats
vacant, the nominee(s) shall be declared elected by acclamation.
(h) In the event that no or insufficient nominations are received by the closing date, the date may be
extended, all seats remain open, and no partial acclamation is declared.

(a) Two members from the Fredericton campus and one from the Saint John campus shall be elected
each yea r.
(b) The term of office shall comm ence I July.
(c) The term of office shall end 30 June.
(d) A member who ceases to be an eligible student in good ac adem ic standing ipso facto ceases to be
a mem ber under theseR egulations
(e) A member elected to fill a vacancy caused by (d) above,death or resign ation, shall be elected to
com plete the term of theform er mem ber.
(f) In the event that a vacancy occurs due to death, resignation or ineligibility, the Council and th e
Gradua te Student Association Executive, where applicable, may designate an eligible student
acceptable to both to serve as an acting m emb er and to atte nd and vote at m eetings of the Board
until an election can take place, such election to be held at the earliest possible opportunity.
7. Duties of the Secretary
(a) The Secretary of the Boa rd, on beh alf of the B oard of G overnors, sh all have the o verall
responsibility for the implementation of these Regulations, and shall report to the Boa rd
ofGovernors as required by the Board or when he deems it necessary.
(b) The Secretary shall enlist the aid of, and coopera te with,the C hief Retu rning Office r of the Co uncil,
or any other Co uncil official given responsibility with respe ct to elections.
(c) Subject to these regulations, elections for student representatives to the Bo ard of Go vernors w ould
norm ally be cond ucted by the Cou ncil in con junction w ith the Co uncil electio ns; how ever, should
the Secretary de em it ne cessary to hold a se parate election, he may do so with the consent of the
Board o r, in the case of tim e constrain ts, of the Ch airman of the Bo ard and th e Presiden t.
(d) In the event of a tied vote, the election shall be determined by lot (e.g. toss of a coin), carried out
by the Secretary in the presen ce of the candid ates or their scrutineers.
(e) The Secretary of the Board is responsible for ensuring that no member continues in office w ho is
ineligible, and for notifying a member who becomes ineligible.
