Terms of Reference:

(Approved by Saint John Senate 24 September 2003, revised 20 September 2006.)

1. A Senate Review Committee shall consist of five Senators, one of whom shall be appointed by the President. The Senate Nominating Committee shall nominate the other four members, one of whom shall be a student (voting except for purposes in relation to determination of examination results and the award of degrees, certificates and diplomas in course). No person who has had any previous involvement with the case may be appointed to the Review Committee. The Senate Secretary will act as secretary to the Committee; the Committee will select its own Chairperson.

2. Normally, the Senate Review Committee would not seek to review the substantive merits of the case which has been heard by the Senate Student Appeals Committee, but would review the Senate Student Appeals Committee process and decision determine if:
a. During the full course of the appeal the proper procedures for the appeal, as described in the University Calendars, have not been followed. If there have been deviations from the normal procedure, the Committee will determine if the student has been disadvantaged in any manner by such deviations;
b. The decision of the Senate Student Appeals Committee has been made in a manner which was fair in all of the circumstances.

3. If the Committee finds in favour of the appellant, it normally shall refer the case back to the Senate Student Appeals Committee for reconsideration, giving reasons for its decision. The Committee may make recommendations to the Senate Student Appeals Committee considering its reconsideration of the case. Senate shall be informed of the Committee’s decision and the action taken.

4. In the exceptional case, where the Review Committee considers that the student would be disadvantaged by a referral back to the Senate Student Appeals Committee, it shall hear the appeal, including a review of the substantive merits, and determine the outcome which shall be substituted for the original decision of the Senate Student Appeals Committee. The decision shall be reported to the Senate.

5. The proceedings of the Committee shall remain confidential.
