Legislation

Duties & Responsibilities

In the province of New Brunswick, industrial safety is regulated under the N.B. Occupational Health & Safety Act, Regulation 91-191, by the Workplace Health & Safety Compensation Commission (WHSCC).

In general, the employers have a number of general duties and responsibilities with regard to equipment, materials and protective devices; information and training supervision; worker protection and safety policy.

Workers must also take reasonable responsibility for personal health and safety with regard to complying with safety policy; wearing protective equipment; reporting unsafe equipment or situations; not operating equipment in an unsafe manner.

Contractors have the same responsibility as employers for: ensuring compliance on the job or project site with provincial safety regulations and University policy; and to ensure the health and safety of all workers on the site is protected.

The University similarly has a legal responsibility to ensure that all contractors working on University property follow University safety policy and provincial health and safety regulations.
