Ivan C. Rand Symposium
In 2007, the Supreme Court of Canada in its decision in Health Services and Support – Facilities Subsector Bargaining Assn v. British Columbia recognized a constitutional guarantee of the right to collective bargaining. This decision resulted in a reassessment of the Supreme Court’s previous jurisprudence on the existence of Charter protections for labour rights and has important implications for the relationship between organized labour and government in Canada.
In conjunction with the Ivan C. Rand Memorial Lecture, UNB Law and the UNB Law Journal hosted a symposium on the topic of the BC Health Services Case and Collective Bargaining Rights in Canada.

The panelists, all of whom are recognized experts in Canadian labour law, discussed the implications of this important case and the future trajectory of the constitutionalization of labour rights in Canada.
This year’s panel was organized by the University of New Brunswick Law Journal. In addition to their contribution to this panel, the participants are all contributing to a Forum on Labour and Employment issues in v.59 of the University of New Brunswick Law Journal forthcoming later this year.
